2006 01 30

Charles Pickering, a retired federal circuit judge who for years was embroiled in a bruising confirmation process after being nominated by President Bush to the 5th U.S. Circuit Court of Appeals in New Orleans, is finally telling his side of the story.

With his new book, “Supreme Chaos - The Politics of Judicial Confirmation & the Culture Wars,” Pickering delves into the gantlet judicial nominees are subjected to, the culture wars that brought about such political battles and the danger of judges legislating from the bench. He also offers long-term suggestions on how to repair the confirmation process.

“One of the ways to try to improve the confirmation process is…

The Politics of Judicial Confirmation and the Culture War

Judge Charles W. Pickering Sr., who was blocked by Democrats from the 5th Circuit Court, will be online Thursday, Jan. 26, at 1 p.m. ET to discuss his book, “Supreme Chaos: The Politics of Judicial Confirmation and the Culture War.”

Hearings on Capitol Hill for recent Supreme Court nominee Samuel A. Alito Jr. have caused concern to some observers, who say the process has gotten out of hand and become more spectacle than congressional process. In “Supreme Chaos,” Pickering says “the judicial confirmation process is broken and badly needs to be fixed,” and that is has become a partisan, personal and contentious process. Pickering’s own confirmation to the Federal District Court was filibustered by Senate Democrats in 2001.

“Supreme Chaos,” by Judge Charles Pickering. Here’s a snippet from the publisher’s description of the book:

In Supreme Chaos, Judge Pickering, who faced unprecedented use of the filibuster by Senate Democrats, provides an insightful assessment of the situation and argues that we must find a way out of the quagmire for the sake of the judiciary, our children and grandchildren, and the rights of all Americans. Pickering’s vision of a repaired confirmation process offers hope that order can be restored from the chaos—that justice under the rule of law as established in the Constitution will prevail.
